COMMISSION TERMS OF SERVICE
The following Terms of Service are effective upon commission agreement between Looking Owl Art, LLC (herein referred to as “Artist”) and the client (herein referred to as “Client”):
General
Terms of Service and Prices are subject to change at any time. The Client shall only be subject to the Terms of Service and Pricing in effect at the commission agreement is submitted and accepted by the Artist. The Artist reserves the right to reject any commission request for any reason. Commission requests that would violate any intellectual property rights or applicable laws will be rejected.
Payment
Upon acceptance of a commission request, the Client will receive communication outlining the approved scope of work. Upon Client approval, the Client will receive an invoice by email for fifty percent (50%) of the total commission cost. All payments are accepted in USD only. The non-refundable deposit payment is due from the Client within ten (10) days to hold the commission reservation. Once the deposit invoice is paid, the commission will be started in the order of the Client waiting queue. If the deposit invoice is not paid within ten (10) days, the commission will be canceled and the Client will receive a notice via email and will lose their place in the queue.
Upon completion of the commission and Client approval, the Client will receive a final invoice for the remaining balance of the commission cost. Upon receipt of final payment, the artwork will be sent to print production. If the Client elects to pay the full commission cost upfront, an invoice for the full amount will be issued and must be paid within ten (10) days.
Right of Refusal
It is the intent of the agreement that the Artist will create an artwork for the Client that the Client will purchase. However, if after the artwork is completed, the Client does not wish to purchase the artwork, the Client may refuse. In that case, the Artist will retain the artwork and the deposit, free of any claims or interests of the Client and the Client will owe no additional fees to the Artist.
Deadlines
Depending on the commission workload, the turnaround time should take approximately 3 weeks. Client will receive an estimated time for completion, and/or notification if there is a delay in completing the commission by estimated deadline. Client shall notify Artist of any specific deadline needed. Artist will make every effort to honor the deadline request, but it is not a guarantee. Clients may request a work in progress update at any time.
Revisions
It is the Client’s responsibility to communicate with the Artist regarding any discrepancies between the scope of work and the artwork execution. There will be regular intervals in which the Artist will communicate with the Client to complete the commission to the Client’s expectations. Client is entitled to two (2) reasonable revisions of the final artwork, depending on the nature and scope of work. Artist agrees to accommodate requested revisions to the best of their ability. Client agrees and understands that any revision requests will extend the original completion estimate. Revisions will be completed in a timely manner.
Copyright & Usage Policy
Commissioned artwork is licensed for personal use, non-commercial use only. Commercial use of commissioned artwork is prohibited unless expressly agreed to in writing. The Artist retains all copyrights and intellectual property rights to the commissioned artwork, including all sketches, drafts, and final files. Copyright ownership is not transferred. Ownership of the physical artwork and/or digital files transfers to the Client only upon receipt of final payment. The Artist retains the right to display the commissioned artwork on the Artist’s website, portfolio, social media, and marketing materials. The Client must advise the Artist in writing prior to completion if the commission is to remain private. The Artist shall receive authorship credit for any artwork displayed publicly or online where credit is reasonably possible.
Artificial Intelligence (AI) Use Prohibited
All commissioned artwork created by Artist remains protected by copyright. Client may not use, upload, submit, reproduce, or distribute any artwork, whether final or preliminary, in connection with AI technologies. This includes, but is not limited to, using the artwork to train, fine-tune, prompt, or feed any AI system, machine learning model, image generator, or dataset, whether for personal, commercial, or experimental purposes. Any unauthorized AI use constitutes copyright infringement and a material breach of this agreement. These restrictions apply regardless of ownership of physical artwork or digital files and survive completion of the commission.
Exclusivity
The Artist agrees that the commissioned artwork will be created exclusively for the Client and will not be resold or licensed to another client as the same commissioned piece. This exclusivity does not limit the Artist’s right to display the artwork for portfolio, promotional, or marketing purposes as outlined in this Agreement..
Refunds
The Artist agrees that if for any reason the Artist is unable to start or fully complete the Client commission, Client shall be refunded in full for any payment previously remitted.
